Silvestri Finds New Buyer

he Silvestri division of Syratech, currently being reorganized under Chapter 11 bankruptcy proceedings, has been sold to Gift Acquisition LLC, a division of investment and technology development firm The D.E. Shaw Group, New York. Shaw also owns toy retailer FAO Schwarz, mytwin.com, and etoys.com. Silvestri will become a wholly owned subsidiary of etoys.com.

According to Edie Lufkin, Silvestri’s general manager and president, who has been leading the search for an appropriate buyer, “the synergies [between Silvestri and etoys.com] in distribution and systems are remarkable,” enabling an almost seamless transition for Silvestri. The company will move from the East Boston, Mass., Syratech headquarters to a new location in Beverly, Mass., by June 1, and will distribute from the etoys facility in Blairs, Va., providing a cost advantage over Silvestri’s current California distribution point. All Silvestri employees and artist licenses will remain with the company, and it will maintain all of its current showrooms and overseas offices. Stripping Silvestri entirely from the Syratech structure, rather than selling it off in parts, was one of Lufkin’s goals. Syratech acquired Silvestri from Fitz and Floyd in 1996.

National Candle Association (NCA) Has Filed A Petition Requesting that Antidumping Duties Be Assessed On Palm And Other Vegetable Based Wax Candles From China

he National Candle Association (NCA) hasfiled a petition with the International Trade Administration of the Commerce Department alleging that imports of palm and other vegetable based candles from China are circumventing the antidumping order on petroleum wax candles from China. The petition requests that the Commerce Department investigate the importation of allegedly “later developed” palm and other vegetable wax candles from China, and assess antidumping duties on these imports, which it claims are undercutting the effectiveness of the current antidumping order on petroleum wax candles from China.

For the past 17 years, petroleum wax candles from China have been subject to general antidumping duties of 54.21 percent, an amount that was increased in April 2004 to 108.3 percent, as a result of an administrative review. The original antidumping Order encompasses candles from China containing at least 50 percent petroleum wax. In contrast, candles that are more than 50 percent beeswax, palm oil wax, etc., have not been subject to the assessment of additional duties, because they were outside the scope of the Order. If the NCA is successful in its petition, however, these vegetable-based wax candles will no longer be exempt from the payment of antidumping duties. This determination could have a significant impact on those TIA members that import candles with their festive articles or novelty items.
